High Voltage Electric Transmission Act
Applications for Certificate of Authority
House Bill 2756 created the High Voltage Electric Transmission Facility Act (the “Act”), which took effect on May 29, 2025, and is now codified at 17 O.S. §§ 850 – 851.
The Act requires transmission developers to file an application to obtain a certificate of authority from the Corporation Commission for each electric transmission facility prior to commencing such facilities.
Applications for certificates of authority must comply with the Corporation Commission’s Chapter 5 Rules of Practice, which can be accessed here: Chapter 5 Rules effective 10/01/2024. See specifically OAC 165:5-7-1 for guidance in preparing applications.
The Corporation Commission utilizes an Electronic Case Filing system (“ECF”) for filing of documents on Commission dockets. To file electronically, you must complete the ECF system registration. Instructions for registering and payment of filing fees can be found in the ECF User Manual on the Corporation Commission’s website at: ECF User Manual.
The ECF system will prompt the user to make selections from drop-down menus throughout the electronic filing process. To initiate the electronic filing, make the following selections:
- Program Area: Public Utility
- Docket Type: Public Utility
- Utility Type: Electric
- Relief Type: High Voltage Transmission COA
Continue following the additional prompts and entering the appropriate information to complete the electronic filing.
