Administrative Letter 25-04 Live-In Caregiver Exemption, Electronic Visit Verification (EVV) Compliance and EVV 2.0 Contract Award
Dear DDS Providers,
On July 1, 2020, Developmental Disabilities Services (DDS) implemented Electronic Visit Verification (EVV) for HTS services due to the federal 21st Century Cures Act, which was signed into law in December 2016. During implementation, the Oklahoma Health Care Authority (OHCA) allowed a live-in caregiver exemption to EVV.
Effective Oct. 1, 2025, the exemption has been removed. As a result, all providers of non-residential HTS (including Self-Directed) are expected to use EVV beginning Oct. 1.
Manual visit entries are not EVV compliant. Compliant entries are those made by the employee via the Authenticare app, or by a landline telephone.
It is understood that mistakes will occur, and not all entries will be compliant. To account for this, OHCA has established a goal of 90% compliance.
The contract for the next EVV system and vendor has been awarded to Acumen Fiscal Agent, LLC. on behalf of OHCA. Transition to this system is expected Fall of 2026. For more information, please refer to this OHCA link Electronic Visit Verification
EVV systems are required to electronically verify:
- Type of service performed
- Individual receiving the service
- Date of the service
- Location of service delivery
- Individual providing the service
- Time the service begins and ends
