340:2-5-114. Hearing request

(a) A hearing request must be in writing and signed by the appealing party.

(b) To be considered timely, a hearing request must be received by the Oklahoma Department of Human Services within:  • 1

(1) 30-calendar days of receipt of the notice of denial or revocation;

(2) 10-calendar days of receipt of an Emergency Order; or

(3) 30-calendar days of receipt of the notice of recording on the Child Care Restricted Registry.

1.When an appealing party indicates the intent to have a hearing in any manner other than by signed writing the Oklahoma Department of Human Servicesemployee to whom this intent is made known:

(1) informs the appealing party of the requirement that a hearing request be made in writing, signed by the appealing party; and

(2) offers any assistance necessary for the appealing party to make a proper hearing request.
